These Terms of Service ("Terms") govern your access to and use of pawmery.com (the "Site"), operated by Pawmery ("Pawmery," "we," "us," or "our"), including our custom pet portrait products and all related communications (together, the "Services").
By visiting the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By using the Services, you confirm that:
- You are legally able to enter into these Terms;
- The information you provide is accurate to the best of your knowledge;
- You own the photo(s) you submit, or have permission to use them for this purpose.
2. What We Do
Pawmery creates custom, illustrated pet portraits printed onto physical products (including blankets, mugs, phone cases, and ornaments) based on the photo(s) and details you provide at checkout.
Every portrait is a hand-illustrated interpretation of your photo. While we aim for a close likeness, minor variations in color, shading, or style are a natural part of the illustration and printing process.
We reserve the right to decline any order at our discretion, including orders that request illegal, hateful, or otherwise inappropriate content.
3. Your Content & Your Responsibility
You are solely responsible for the photo(s) and details you submit. By submitting content, you confirm that:
- You own the photo or have the right to share it;
- It does not infringe on anyone's copyright or other rights;
- It is not unlawful, obscene, or otherwise inappropriate.
You agree to hold Pawmery harmless from any claim arising from content you submit to us.
4. License You Grant to Us
By submitting your photo, you grant Pawmery a non-exclusive, royalty-free license to use, reproduce, and adapt that photo solely for the purpose of creating, producing, and delivering your custom product. This does not give us ownership of your photo — only permission to use it to complete your order.
5. Free Design & Revisions
We design and revise your portrait at no additional cost until you approve the final mockup. Production does not begin until you confirm you're happy with the design. Once you've approved your mockup and production has started, changes can no longer be made.
6. Communications
By providing your email, you agree to receive order-related communications (confirmations, mockup approvals, shipping updates, support replies). We may also send occasional promotional emails, which you can unsubscribe from at any time.
7. Delivery
Estimated production and shipping times are shown at checkout and on the product page. We are not responsible for delivery delays caused by an incorrect shipping address, carrier issues, or events beyond our control.
8. Returns & Refunds
Because every item is custom-made specifically from your photo, we're unable to accept returns, exchanges, or refunds once production has begun. Please review your photo, pet's name, and order details carefully before checkout.
9. Issues With Your Order
If your item arrives damaged, defective, or different from what you approved, contact us at hello@pawmery.com within 15 days of delivery with photos of the issue. We'll review and arrange a free remake or resend at no additional cost. Claims made after 15 days may not be eligible for a replacement.
10. Prohibited Uses
You agree not to:
- Use the Services for any unlawful purpose;
- Submit a photo or content that infringes on someone else's rights;
- Attempt to disrupt, scrape, or reverse-engineer the Site;
- File a fraudulent chargeback.
11. Disclaimer of Warranties
The Services and products are provided "as is." To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.
12. Limitation of Liability
To the fullest extent permitted by law, Pawmery is not liable for indirect, incidental, or consequential damages arising from use of the Services. Our total liability for any claim will not exceed the amount you paid for the order in question.
13. Indemnification
You agree to indemnify and hold harmless Pawmery and its owners and contractors from any claim arising from content you submit or your violation of these Terms.
14. Third-Party Services
We rely on third-party providers for payment processing, hosting, and email delivery, and are not responsible for outages or failures of these services.
15. Force Majeure
We are not liable for delays caused by events beyond our reasonable control, including natural disasters, internet or platform outages, or government actions.
16. Chargebacks
If you file a chargeback without contacting us first at hello@pawmery.com, you give up eligibility for a resolution under Section 9, and we reserve the right to dispute the chargeback and decline future orders from you.
17. Changes to These Terms
We may update these Terms from time to time. Continuing to use the Services after an update means you accept the revised Terms.
18. Severability
If any part of these Terms is found unenforceable, the rest will remain in effect.
